In these terms and conditions, the words "website" refers to the Mae Mae Care website, "we", "us", "our" and "Mae Mae Care" refers to Mae Mae Care and "user", “customer”, "you" and “your" refers to you, the user and customer of Mae Mae Care.

The following terms and conditions apply to the website, products and services offered by Mae Mae Care. This includes the mobile and tablet versions as well as any other version of Mae Mae Care accessible via desktop, mobile, tablet, social media or other devices.

1. SCOPE

1.1. These Terms and Conditions apply to the entire business relationship between you and us, unless otherwise expressly agreed in writing between you and us.

1.2. These Terms and Conditions apply regardless of whether the customer purchases our products as a consumer (§ 13 BGB) or entrepreneur (§ 14 BGB). A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither related to their commercial nor their self-employed professional activity. An entrepreneur is any natural or legal person or legal entity that acts in the exercise of its commercial or self-employed professional activity when concluding a legal transaction.

1.3. The version of these Terms and Conditions that is valid at the time of a contract conclusion is always applicable.

1.4. Representations, side agreements or other contract changes that you wish are only valid if they are expressly confirmed in writing by us. If we have not agreed in writing in the individual case, opposing or deviating conditions will not be recognized. You may use the website and purchase the products only in compliance with these terms and all applicable local, state, national, and international laws, rules, and regulations.

1.5. Access to the website and purchase of products are available to all ages. It is the responsibility of parents or legal guardians to determine whether the content and products are appropriate for their children or minors in their care.

1.5.1. By using the website and purchase the products, you represent and warrant that you have the full right, power and authority to enter into these terms and to fully perform all of your obligations hereunder. You further represent and warrant that you are under no legal disability or contractual restriction that prevents you from entering into these terms.

1.5.2. You represent and warrant that your use of the website does not violate any applicable law or regulation. Mae Mae Care may, in its sole discretion, refuse to offer the website and products to any user and change its eligibility criteria at any time. This provision is void where prohibited by law and the right to access the service and the website is revoked in such jurisdictions.

1.6. The contract is concluded in German.

2. ACCOUNT 

​

2.1. Users have the option to register on the website. When registering on the website, the user must complete the registration form and create a password. 

​

2.2. You are responsible for maintaining the confidentiality of your password and account information, and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify Mae Mae Care of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you log out of your account at the end of each session.

2.3. You may never use another user's account without prior authorization from Mae Mae Care.

2.4. Users may cancel their accounts at any time and for any reason through the account settings or by sending us their request through our contact information. Such cancellation will only result in the deletion of the account and the deletion of all personal data provided to Mae Mae Care.

2.5. Mae Mae Care reserves the right to terminate your account or your access immediately, with or without notice, and without liability to you, if Mae Mae Care believes that you have violated any of these terms and conditions.

3. NOTIFICATIONS AND NEWSLETTER

​

3.1. By providing Mae Mae Care with your email address and phone number, you agree that we may use your email address to send you notifications about the status of your order, important communications about our services or products, news and special content. 

​

3.2. If you do not wish to receive these emails or SMS messages, you may opt out of receiving them by sending us your request through our contact information or by using the "unsubscribe" option in the emails. This option may prevent you from receiving emails or messages about updates to your order, news or special offers on our products.

4. ORDERS AND PRODUCT AVAILABILITY

​

4.1. When you place an order, you offer to buy the products for the price advertised and indicated on the website at the time of purchase. Please check the characteristics and variants of the products before placing your order.

4.2. When a customer places an order, Mae Mae Care will send that customer an email which aims to confirm the purchase and payment. This email confirmation will be produced automatically so that the user has the confirmation of his purchase and the details of the order. 

​

4.3. We reserve the right to limit the number of units purchased by each user. Mae Mae Care also reserves the right to limit sales of our products on a regional or jurisdictional basis.

​

4.4. Mae Mae Care may cancel any order and not supply products if it is reasonable to do so and may change or discontinue the availability of products at any time at its sole discretion. If an order is cancelled by Mae Mae Care, any payments made on the order will be refunded in full. This does not affect your statutory rights.

​

4.5. As a rule, we constantly check the availability of our products to ensure that orders can only be placed for available items. In exceptional situations where a product is not available despite what is indicated on our website, we will not proceed to accept such an order or process it. If, by mistake, an order for an unavailable product is processed, we will contact you immediately to inform you of the situation and will proceed with a full refund of any payment made as soon as possible.

4.6. All new orders are considered separately and each is treated individually.

4.7. The contract text will not be retained.

​

4.8. If you order our products by phone, letter, fax or email, instead of through our online shop, the following applies: Your order is a binding offer to enter into a contract. A contract is only concluded when we accept your offer. We have the right to accept your offer within 14 days of receiving it. We can accept your offer either in writing (e.g. by sending you an order confirmation) or by shipping the products to you. If we accept your offer by shipping the products to you, we do not need to send you a separate acceptance notice.

4.9. The following delivery restrictions apply: Mae Mae Care only delivers to customers who have their usual residence (billing address) in one of the following countries and can provide a delivery address in the same country: Germany, Austria, Switzerland.

5. DELIVERY TERMS / DELIVERY COSTS

5.1. All prices on our website or outside our online shop are in euros, including VAT, but excluding shipping costs and insurance. If you choose to have your order shipped to Switzerland, the prices will be displayed in Swiss francs (CHF).

5.2. Mae Mae Care reserves the right to determine the price of the products. Product pricing will be available on each product page. Product prices and shipping costs are subject to change at any time.

5.3. Mae Mae Care will make reasonable efforts to keep the price information published on the website up to date. We encourage you to check our website periodically for current pricing information.

​

5.4. Will always try to make sure that the prices on the website is accurate. However, some errors in terms of price may occur from time to time, including but not limited to human error, mechanical error or the like. Should an error in pricing be discovered, the customer will be informed of such error. The option to reconfirm the order will be given to the user at the correct price. The user also has the option to cancel the order should the user not be satisfied with the correct price communicated on the said product order.

6. TERMS OF PAYMENTS

6.1. Products will be paid through the following payment methods:

• Prepayment by bank transfer, Credit/debit card (Visa, Mastercard), PayPal, Shop Pay, Google Pay, Stripe and Klarna.

6.2. The customer must pay the price of the product stipulated in the order before the product is shipped. Payment will be charged to the payment method selected by the customer immediately after placing the order for the products purchased. Once the transaction has been processed, we will send an electronic receipt of the transaction to the customer's email address.

​

6.3. If you find any inconsistency in your billing, please contact us through our contact information or you can make the claim through the customer service of the corresponding payment processor.

​

6.4. If your card is declined, you will receive an error message. No payment will be charged to your card and no order will be processed. There may be a pending transaction on your account until your card issuing bank withdraws the authorization. This usually takes 2 to 5 business days. Your card may be declined for various reasons such as insufficient funds, AVS (Address Verification System) mismatch or you have entered an incorrect security code.

6.5. If your payment is declined, you must provide an alternative payment method or provide another card where payment can be charged and processed.

​

6.6. Your payment information will be treated and safeguarded with total security and with the exclusive purpose of processing the purchase of the products. Mae Mae Care reserves the right to contract any payment platform available in the market.

​

6.7. The purchase price is due immediately upon conclusion of the contract, unless otherwise specified by the selected payment method. If payment is due on a specific date, you will be in default if you miss that date. If you are a consumer, you will owe us interest at the rate of five (5) percentage points above the base interest rate for each year that you are in default. If you are an entrepreneur, the interest rate is nine (9) percentage points above the base interest rate.

6.8. Your obligation to pay default interest does not prevent us from claiming further damages caused by your default.

7. PRODUCT DESCRIPTIONS

​

7.1. While Mae Mae Care strives to provide accurate and up-to-date descriptions of the natural cosmetic products offered, we do not warrant that the descriptions, colors, ingredient information, and other content related to the products are completely accurate, complete, or error-free.

8. DISCOUNT CODES

​

8.1. You can only use one discount code per order. Mae Mae Care reserves the right to refuse or cancel any order where multiple discount codes are added to the shopping cart. 

​

8.2. The use of discount codes is subject to the specific terms and conditions under which they were issued, which may include eligibility requirements and a maximum order value. 

​

8.3. In the event of a conflict between the terms and conditions of a promotion and these terms and conditions, the terms and conditions of the promotion shall prevail.

​

8.4 The application of discount codes to goods that are already discounted is excluded. This applies in particular to goods that are offered as part of special promotions or price reductions. A combination of discount codes with other discounts or price reductions is therefore not permitted. Discount codes can only be redeemed during the specified promotional period and under the conditions described in the respective promotion. Subsequent crediting of discount codes is excluded.

9. PROMOTIONS AND SWEEPSTAKES

9.1. From time to time, Mae Mae Care may offer its users and customers the opportunity to participate in sweepstakes or other promotions. 

​

9.2. You may not transfer, assign, sell, trade, exchange or barter any prize or other benefit received through a sweepstakes or promotion. 

​

9.3. Any prize or other benefit is provided "as is" without any express or implied warranty by us, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

​

9.4. Mae Mae Care reserves the right to modify, terminate or suspend the availability of sweepstakes and promotions and to correct errors or inconsistencies in materials related to sweepstakes and promotions. 

​

9.5. Mae Mae Care may disqualify any person who tampers with any promotion. It is important to note that any attempt to deliberately undermine the legitimate operation of a promotion or sweepstakes is a violation of criminal and civil laws, and Mae Mae Care reserves the right to seek damages from such persons to the fullest extent permitted by law.

​

9.6. By entering a promotion or sweepstakes, you agree to submit to our decisions, which are final and binding in all matters relating to the promotion or sweepstakes. Promotions and sweepstakes are subject to all applicable federal, state and local laws, rules and regulations. Promotions are void where prohibited, restricted or taxable.

9.7. By participating in a promotion or sweepstakes, you agree to hold Mae Mae Care harmless from any liability, loss or damage arising out of or related to your participation in any activity related to the promotion or sweepstakes or the receipt, use or misuse of any prize you may receive.

10. RETENTION OF TITLE CLAUSE

​

10.1. If the customer is a consumer, the delivered products remain the property of Mae Mae Care until the purchase price has been paid in full.

​

10.2. If the customer is an entrepreneur, the delivered products remain the property of Mae Mae Care until all current and future claims arising from this contractual relationship and an ongoing business relationship (secured claims) have been met.

​

10.3. If the customer is an entrepreneur, the following sections 10.4 to 10.6.3 apply.

​

10.4. The products subject to retention of title may neither be pledged to third parties nor assigned as security until the secured claims have been paid in full. The customer must notify Mae Mae Care immediately in writing if an application is made to open insolvency proceedings or if third parties access (e.g. seizures) products belonging to Mae Mae Care.

​

10.5. If the customer behaves in breach of contract, in particular if the purchase price due under this purchase contract is not paid, Mae Mae Care is entitled to withdraw from this purchase contract and/or to demand the return of the products on the basis of retention of title. A request for release does not also include a declaration of withdrawal; Rather, Mae Mae Care is entitled to simply demand the return of the products and reserve the right to withdraw from the contract. If the customer does not pay the purchase price due, Mae Mae Care may only assert these rights if it has previously unsuccessfully set the customer a reasonable deadline for payment or if such a deadline is unnecessary according to legal regulations.

10.6. Until revoked in accordance with Section 10.5, the customer is authorized to resell the products subject to retention of title in the ordinary course of business. In this case, the following additional provisions apply:

10.6.1. The customer hereby assigns all claims against third parties arising from the resale of the products to Mae Mae Care. Mae Mae Care accepts the assignment. The customer's obligations stated in Section 10.4 also apply with regard to the assigned claims.

10.6.2. The customer remains authorized to collect the claim alongside Mae Mae Care. Mae Mae Care undertakes not to collect the claim as long as the customer meets his payment obligations to Mae Mae Care, there is no defect in his ability to perform and Mae Mae Care does not assert the retention of title by exercising a right in accordance with Section 10.5. However, if this is the case, Mae Mae Care can demand that the customer inform Mae Mae Care of the assigned claims and their debtors, provide all the information required for collection, hand over the associated documents and inform the debtors (third parties) of the assignment . In this case, Mae Mae Care is also entitled to revoke the customer's authority to further sell the product subject to retention of title.

10.6.3. If the realizable value of the securities exceeds the claims by more than 10%, Mae Mae Care will release securities of its own choice at the customer's request.

11. RIGHT OF WITHDRAWAL

11.1. Description of the Right of Withdrawal: The right of withdrawal allows consumers in the European Union to cancel an online purchase within 14 days of receipt of the product without having to justify their decision. This right applies to most of the products purchased, except in the cases indicated in the exclusion section.

11.2. How to Exercise the Right of Withdrawal: To exercise this right, the consumer must inform us of his decision to withdraw from the contract by means of an unequivocal statement. This can be done by sending an email or by using the withdrawal form provided at the end of this policy. The notification must be made within the 14-day period mentioned above.

11.3. Consequences of Withdrawal: After exercising the right of withdrawal, we will refund all payments received, including standard shipping costs, no later than 14 days from the day on which we are informed of your decision to withdraw from the contract. We will use the same means of payment that you used for the initial transaction, unless expressly agreed otherwise. The refund may be withheld until we have received the goods back or until proof of their return is provided, whichever occurs first.

11.4. Exclusion of the Right of Withdrawal: The right of withdrawal does not apply in certain cases, including, but not limited to: custom-made or personalized goods, perishable goods, sealed products that are not suitable for return for reasons of health protection or hygiene and that have been unsealed after delivery, and digital content not supplied on a material medium if performance has begun with the consumer's prior consent and acknowledgement that he will lose his right of withdrawal.

11.5. Model Form for Withdrawal: If you wish to terminate the contract, please fill in this form and send it to us by mail or e-mail (hi@maemaecare.com).

11.6. Return of goods: The consumer must comply with the following requirements when returning the goods when exercising his right of withdrawal:

​

• The direct costs of returning the goods shall be borne by the consumer.

• The consumer shall be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

• The consumer must return or directly deliver the goods without undue delay and in any event no later than 14 days from the day on which he communicates his withdrawal from the contract to us.

12. WARRANTY FOR MATERIAL DEFECTS, GUARANTEE

12.1. We are liable for material defects in accordance with the applicable legal provisions, in particular §§ 434 ff. BGB. For entrepreneurs, the warranty period for products supplied by us is twelve (12) months. Liability, including the limitations of liability in accordance with Section 13, remains unaffected by this Section 12.1.

13. LIMITATION OF LIABILITY

13.1. Customers should follow the directions for use and recommendations provided with each product. Mae Mae Care assumes no responsibility for misuse of the products or failure to follow directions for use.

​

13.2. Customers should be aware that, although the products are natural, there may be risks of allergic reactions or irritation in certain individuals. It is the customer's responsibility to verify ingredients and perform a sensitivity test prior to full application.

​

13.3. In no event shall Mae Mae Care be liable for any direct, indirect, incidental, special or consequential damages, including but not limited to, irritations, allergies, or any other adverse effects resulting from the use of the natural cosmetic products sold through this website.

​

13.4. Mae Mae Care reserves the right to make changes to products, including changes in ingredients, packaging or labeling, at any time without notice. However, we undertake to keep relevant information on our website up to date. 

​

13.5. By visiting the website and accessing the content available on the website, you accept personal responsibility for the results of the use of the information and content available on the website. You agree that Mae Mae Care does not guarantee the results of actions advised or not advised by this website and the content available on the website.

13.6. Mae Mae Care provides resources and content for informational purposes only. You acknowledge and agree that your ultimate success or failure to use the information and content available on the website will be the result of your particular situation and a number of other circumstances beyond Mae Mae Care's control. 

13.7. This limitation of liability clause is not intended to exclude any warranty implied by law that cannot be lawfully excluded.

14.2. You acknowledge and agree that all materials on the website are made available for personal, limited, non-commercial use only. Except as specifically provided herein.

14.3. No material may be copied, reproduced, republished, sold, downloaded, posted, transmitted or distributed in any way, or otherwise used for any purpose, by any person or entity, without the prior express written permission of Mae Mae Care.

14.4. You may not add to, delete, distort or otherwise modify the material. Any unauthorized attempt to modify any material, to override or circumvent any security features, or to use the website or any portion of the website content for any purpose other than its intended purpose is strictly prohibited. Please do not copy any content and pass it off as your own, as this will result in copyright infringement.

15. COPYRIGHT COMPLAINTS

15.1. Mae Mae Care will respond to all inquiries, complaints and claims relating to alleged infringement or violation of the provisions contained in European and international copyright and intellectual property laws and regulations.

15.2. Mae Mae Care respects the intellectual property of others and expects users to do the same. If you believe, in good faith, that any material provided on the Mae Mae Care website infringes your copyright or other intellectual property rights, please submit your request using our contact information, with the following information:

• Identification of the intellectual property right that is allegedly infringed. All relevant registration numbers, or a statement concerning the ownership of the work, should be included.

• A statement specifically identifying the location of the infringing material, with enough detail that Mae Mae Care may find it on the website.

16. PROHIBITED ACTIVITIES

17. DISCLAIMER OF WARRANTIES

17.1. Due to the nature of the Internet, Mae Mae Care provides and maintains the website on an "as is", "as available" basis and does not promise that use of the website will be uninterrupted or error-free.

17.2. Our website may from time to time contain links to other websites that are not under our control or operated by us. These links are provided for informational or operational purposes only and we are not responsible for their content.

17.3. Except as provided above we can give no other warranties, conditions or other terms, express or implied, statutory or otherwise and all such terms are hereby excluded to the maximum extent permitted by law.

17.4. You will be responsible for any breach of these terms by you and if you use the website in breach of these terms you will be liable to and will reimburse Mae Mae Care for any loss or damage caused as a result.

Mae Mae Care shall not be liable for any amount for any failure to perform any obligation hereunder if such failure is due to the occurrence of any unforeseen event beyond its reasonable control, including, without limitation, Internet outages, communications outages, fire, flood, war or force majeure.

17.6. These terms do not affect your statutory rights as a consumer which are available to you.

17.7. Subject as aforesaid, to the maximum extent permitted by law, Mae Mae Care excludes liability for any loss or damage of any kind howsoever arising, including without limitation any direct, indirect or consequential loss whether or not such arises out of any problem you notify to Mae Mae Care and Mae Mae Care shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:

• Any incorrect or inaccurate information on the website.

• The infringement by any person of any Intellectual Property Rights of any third party caused by their use of the website or any product purchased through the website.

• Any loss or damage resulting from your use or the inability to use the website or resulting from unauthorized access to, or alteration of your transmissions or data in circumstances which are beyond our control.

• Any loss of profit, wasted expenditure, corruption or destruction of data or any other loss which does not directly result from something we have done wrong.

19. INDEMNIFICATION

You agree to defend and indemnify Mae Mae Care and any of their directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of:

• Your violation of any law or the rights of a third party.

• Your purchase of the products.

20. ELECTRONIC COMMUNICATIONS

20.1. No responsibility will be accepted by Mae Mae Care for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet accessibility or availability or for traffic congestion or unauthorized human act, including any errors or mistakes. 

21. CHANGES AND TERMINATION

21.1. We may modify the website and these terms at any time, at our sole discretion and without notice.

21.2. You are responsible for keeping yourself informed of these terms. Your continued use of the website constitutes your acceptance of any changes to these terms and any changes will supersede all previous versions of the terms.
